Our Contentious Insolvency and Investigations Service
There are times when contentious issues lie at the heart of an insolvency, such as fraud or wrongful trading and a specialist investigation is needed to maximise recoveries for creditors.
A company can be said to be insolvent when it cannot pay its monthly outgoings in full, as and when they fall, or when its liabilities outweigh its assets. Insolvency can be caused by many different factors including rising costs, mismanagement or the inability to operate under restrictions due to wider factors such as a global pandemic.
A case maybe considered to be ‘contentious’ where there is suspicion of fraud or financial misconduct and a thorough investigation is required in order to uncover the facts and gather evidence. Once the investigation is completed, the office holder may look to commence legal proceedings with a view to recovering value to the benefit of creditors.
Contentions insolvency cases can be highly complex and take a long time to resolve.
How we work
In these situations, our experienced insolvency investigators work closely with creditors and legal teams, using the powers afforded to liquidators and trustees in bankruptcy by the Insolvency Act 1986.
We have the expertise in intricate, forensic accounting and analytical investigation to identify and recover assets which may be hidden or to identify other avenues of recovery from those benefiting from the fraud. Invariably, these matters require multiple court applications, legal proceedings and mediation.
Our team leaders also act as Expert Witness in legal proceedings.
As founding members of The International Accountancy Group (TIAG) and the wider TAG Alliances, we also have a strong network of firms across the globe to work with to quickly solve cross-border issues.
