Mercer & Hole Corporate Advisory Partner, Chris Laughton will be chairing an R3 breakfast briefing ‘Life post Brexit – Insolvency Issues’ on 20 June at Wedlake Bell in London.

The event will see a panel, consisting of a lawyer, an IP and an academic, considering the implications of a deal or no deal Brexit on cross-border restructuring and insolvency.

Stefan Ramel of Guildhall Chambers will look at where we are now in the process; and if we leave without a deal, what law applies to cross-border restructuring and insolvency. He will also consider transitional arrangements if we leave with a deal and the direction of travel post transition.

Chris Laughton, a cross-border insolvency specialist, will focus on practicalities, centred around communication and co-operation in the context of having to deal with 27 different cross-border restructuring and insolvency regimes. He will also consider the use of protocols and other agreements, and illustrate how the Regulation and the Recast Regulation are not a panacea in practice.

Sarah Paterson, an associate professor of law at LSE, will offer her academic perspective on what solutions may be available to UK practitioners in other European courts and consider, for example, whether synthetic orders could be promoted, how European judges will react, and the potential help of the Model Law.
