There has always been a grey area for some people between employment and self-employment. The recent case involving Weight Watchers gave a few useful pointers. As ever the matters reviewed included mutuality, control and substitution, and highlighted the problems where no formal documentation exists. This is a perennial issue with HMRC and likely to be of more interest going forward with the higher rates of national insurance for employees.
